Compliance with ADA Accessibility Regulations Delayed

On Monday, the Department of Justice (DOJ) announced revisions to regulations implementing Title II of the Americans with Disabilities Act (ADA) that extend the compliance dates for web content and mobile application accessibility adopted in April 2024. The change will impact the implementation of accessibility features for public K-16 websites and mobile applications used by students and families. Compliance deadlines are extended by one year: to April 26, 2027, for State and local governments serving populations of 50,000 or more, and to April 26, 2028, for smaller public entities and special district governments. DOJ notes it is seeking to “strike a balance between covered entities’ burdens and ensuring accessibility for individuals with disabilities and believes an extension is appropriate.” 

Disability advocates, led by the American Association of People with Disabilities (AAPD), oppose the deadline extension, noting in part that it “undermines timely access to digital services for people with disabilities” and that “courts had already long held that website accessibility is mandated under the ADA.”
